Introduction

Presriptd, LLC (“Prescriptd” or “we”) respects user privacy and is committed to protecting the privacy of you, the user (“User” or “you”), through compliance with this Prescriptd Privacy Policy (“Policy”). This Policy describes:

  • The types of information Prescriptd may collect or that you may provide when you download, install, register with, access, or use the Prescriptd™ mobile application or website, www.prescriptd.com (the Prescriptd™ mobile application and website being, collectively , the “App”); and
  • Prescriptd’s practices for collecting, using, maintaining, protecting, and disclosing that information.

This Policy applies only to information we collect in the App and in email, text, and other electronic communications sent through or in connection with the App. This policy DOES NOT apply to information that:

  • We collect offline or on any other websites you may access through this App;
  • You provide to or is collected by any third party (see Third-Party Information Collection ).

Other third parties have their own privacy policies, which we encourage you to read before providing information to such third parties.


Read this Policy carefully to understand Prescriptd’s policies and practices regarding your information and how we will handle and use information. If you do not agree with our Policy, including the policies and practices explained in this document, do not download, register with, or use the App. By downloading, registering with, or using the App, you agree to this Policy. This Policy may change from time to time (see Changes to Our Privacy Policy ). your continued use of the App after we revise this Policy means that you accept those changes. you are solely responsible for checking the Policy periodically for updates.


This App is intended for use by individuals 18 years or older who are located in the United States, and particularly the state of Texas, and who are existing patients of a Provider Prescriptd partners with. If you do not meet these terms, you are not authorized to use the App.

Children Under the Age of 18

The App is not intended for children under 18 years of age, and we do not knowingly collect personal information from children under 18. If we learn that we have collected or received personal information from a child under 18, we will delete that information. Information We Collect and How We Collect It

We collect information from and about Users of the App:

  • Directly from your when you provide it to us via the App;
  • From your healthcare provider;
  • Automatically when you use the App; and
  • Directly from your when you provide it to us via communications.

Information You Provide to Us

When you download, register with, or use the App, we may ask you to provide information:

  • By which you may be personally identified, such as name, postal address, email address, telephone number, profile information, photograph or image information, mobile device identifier(s), locations, and any other identifier by which you may be contacted online or offline (“Personal Information”).
  • That is about you but individually does not identify you, such as symptoms, health care provider information, pharmacy, insurance, and prescription.
  • For healthcare providers, Your National Provider Number (“NPI”), medical specialty or other professional credential information.

Personal Information includes, without limitation:

  • Information that you provide by filling in forms in the App. This includes information provided at the time of registering to use the App, posting material, reporting symptoms, and requesting further services. We may also ask you for information when you use the App or when you report a problem with the App.
  • Records and copies of your correspondence (including email addresses and phone numbers), if you contact us.
  • Your responses to surveys that we might ask you to complete for research purposes.
  • Details of transactions you carry out through the App and of the fulfillment of your prescription(s).
  • Your search queries on the App.
  • Your profile information.

Automatic Information Collection and Tracking

When you download, access, and use the App, Prescriptd may use technology to automatically collect:

  • Usage Details. When you access and use the App, we may automatically collect certain details of your access to and use of the App, including traffic data, location data, logs, and other communication data and the resources that you access and use on or through the App.
  • Device Information. We may collect information about your mobile device and internet connection, including the device’s unique device identifier, IP address, operating system, browser type, mobile network information, and the device’s telephone number.
  • Stored Information and Files. The App also may access metadata and other information associated with other files stored on your device. This may include, for example, photographs, audio and video clips, personal contacts, and address book information.

If you do not want Prescriptd to collect this information about you and your device, do not download the App or delete it from your device. You may opt out of certain data collection at any time and choose to opt-out by contacting info@prescriptd.com. Note, however, that opting out of the App’s collection of location information may disable some features.

Prescriptd does not share end user information with third-party marketers or advertisers for behavioral targeting, advertising, or other marketing or promotional purposes.

Information Collection and Tracking Technologies

The technologies we use for automatic information collection may include:

  • Cookies (or mobile cookies). A cookie is a small file placed on your smartphone. It may be possible to refuse to accept mobile cookies by activating the appropriate setting on your smartphone. However, if you select this setting, you may be unable to access certain parts of our App.
  • Web Beacons. Pages of the App and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email and for other related app statistics (for example, verifying system and server integrity).

Information Collection from Third Parties

We also may receive your information from third parties to enhance our services. This information may be collected in the following ways:

  • Healthcare Professionals and Providers: We may receive information from your healthcare professionals. Prescriptd partners with healthcare providers to permit their patients to use the App Healthcare professionals may submit digital enrollment forms, conduct benefits checks or prior authorizations, or otherwise make available your health information to Prescriptd on your behalf.
  • Data Partners: We may enhance your information with information from third parties, including professional and contact information, medical information (such as condition), demographic information, interest information, information regarding online activities across devices and online platforms and offline activities such as purchase history.
  • Pharmacy benefit managers or pharmacies: Most prescriptions purchased in the United States, including prescriptions filled using discount coupons, loyalty cards, or insurance copays, result in the pharmacy reporting patient data back to the pharmacy benefit manager. When you obtain a prescription using the App, we may receive information about the transaction from the corresponding pharmacy benefit manager or the applicable pharmacy.

We may combine the various information we collect about you across other computers or devices that you may use and from third-party sources.

Information Collection by Third Parties

When you use the App or its content, certain third parties may use automatic information collection technologies to collect information about your or your device. These third parties may include:

  • Advertisers, ad networks, and ad servers.
  • Analytics companies.
  • Your mobile device manufacturer.
  • Your mobile service provider.

These third parties may use tracking technologies to collect information about your when you use the App. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites, apps, and other online services websites. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content. We do not control these third parties’ tracking technologies or how they may be used. We do not permit or promote ads on the App. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information, to:

  • Provide you with the App and its contents, and any other information, products or services that you request from us.
  • Provide your healthcare provider with the information you provide regarding your symptoms.
  • Fulfill any other purpose for which you provide it.
  • Give you notices about your account.
  • Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
  • Notify you when App updates are available, and of changes to any products or services we offer or provide though it.

The usage information we collect helps us to improve our App and to deliver a better and more personalized experience by enabling us to:

  • Estimate our audience size and usage patterns.
  • Speed up your searches.
  • Recognize you when you use the App.

Disclosure of Your Information

Prescriptd may disclose aggregated information about our users, and information that does not identify any individual or device, in compliance with applicable law. Prescriptd takes steps to comply with applicable law for storage and disclosure of personal information and personal health information. In addition, Prescriptd may disclose personal information that we collect or you provide:

  • To Prescriptd, our subsidiaries, and affiliates.
  • To contractors, service providers, and other third parties we use to support our business.
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of the Company’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by the Company about our App users is among the assets transferred.
  • To your healthcare provider.
  • To fulfill the purpose for which you provide it.
  • For any other purpose disclosed by us when you provide the information.
  • With your consent.
  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • To enforce our rights arising from any contracts entered into between you and Prescriptd, including the terms of use for the App, subscriptions, and for billing and collection.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Prescriptd, our users, or others.

Your Choices About Our Collection, Use, and Disclosure of Your Information

We strive to provide you with choices regarding the personal information you provide to us. This section describes mechanisms we provide for you to control certain uses and disclosures of over your information.

  • Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies or block the use of other tracking technologies, some parts of the App may then be inaccessible or not function properly.
  • Disclosure of Your Information to Your Healthcare Provider. Prescriptd partners with participating healthcare providers and may share the information you provide with your healthcare provider to enable your healthcare provider to provide you with adequate care.

Accessing and Correcting Your Personal Information

You can review and change your personal information by logging into the App and visiting your account profile page. You may also send us an email at info@prescriptd.com to request access to, correct, or delete any personal information that you have provided to us. In certain circumstances, we may need to delete your personal account in order to delete your personal information. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Data Security

We have implemented measures designed to secure your personal information and personal health information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls. Any payment transactions will be encrypted. The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our App, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.


Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although Prescriptd makes reasonable efforts to protect personal information of users and to comply with applicable law regarding personal health information, Prescriptd cannot guarantee the security of your personal information transmitted through our App. Any transmission of personal information via the App is at your own risk. Prescriptd is not responsible for circumvention of any privacy settings or security measures we may provide.

Additional Privacy Disclosures

Prescriptd Services

Prescriptd partners with healthcare professionals (“Providers”) to offer a platform that enables patients to seek treatment for common ailments virtually. Prescriptd does not collect our retain information about you for any purpose other than for the App services and is not a healthcare provider or professional. Your Provider is responsible for providing you with its own notice of Privacy Policy, which describes how it may use and disclose your Personal Information and health information. If you do not agree to be bound by those terms, you are not authorized to access or use Prescriptd services. This App is intended only for use by patients of participating Providers. Note that the Providers we contract with may change from time to time.

European Union Visitors

Please do not use the App if you are not a resident of the United States. The App is intended for use only by residents of the United States. Use by visitors from the European Union, the United Kingdom, or any State outside of the United States, is prohibited.

Consumer Health Data Privacy Notice

This Consumer Health Data Privacy Notice applies to personal data defined as “consumer health data” (“CHD”) under applicable state privacy laws. The CHD we collect depends on how you interact with us, the services you use, and the choices you make. Because CHD is defined broadly, many of the categories of data we collect may be considered CHD.  


Such data may also be categorized as follows:

  • Information about your health-related conditions, symptoms, status, diagnoses, testing, or treatments (including surgeries, procedures, medications, or other interventions).
  • Precise location information that could reasonably indicate your attempt to acquire or receive health services or supplies.
  • Information that could identify your attempt to seek health care services or information, including services that allow you to assess, measure, improve, or learn about your or another person’s health. For example, your interactions with us could involve queries or reveal information about you concerning prescriptions or other health-related topics. 
  • Information about your prescriptions, such as your provider and pharmacy information, to facilitate fulfillment of your prescription.
  • Other information that may be used to infer or derive data related to the above or other health information.

Sources of Consumer Health Data

CHD is sourced directly from you, from your interactions with our App, and from third parties and service providers.

Why We Collect and Use Consumer Health Data

We collect and use CHD as reasonably necessary to provide you with the services you have requested or authorized. This may include providing you with health or symptom related information or a prescription, communicating with you, ensuring the secure and reliable operation of the App and the systems that support them, troubleshooting and improving the App, and other essential business operations that support the provision of the App (such as analyzing our performance, meeting our legal obligations, developing our workforce, and conducting research and development).

Our Sharing of Consumer Health Data

We may share each of the categories of CHD described above for the purposes described herein. In particular, we may share CHD with your consent or as reasonably necessary to complete any transaction or provide your healthcare provider with information pertaining to your health and symptoms.  


As necessary for the purposes described above, we share CHD with the following categories of third parties: 

  • Healthcare providers. We may share CHD with your authorized healthcare providers.
  • Affiliates and subsidiaries. We may share information with our subsidiaries and affiliated companies for business and operational purposes.
  • Service providers and third parties. Vendors or agents working on our behalf may access CHD for the purposes described above.
  • For corporate transactions. We may disclose CHD as part of a corporate transaction or proceeding such as a merger, financing, acquisition, bankruptcy, dissolution, or a transfer, divestiture, or sale of all or a portion of our business or assets.
  • For legal obligations/safety. We may be required to share CHD for things like compliance with a valid legal process, such as a subpoena, court order, or search warrant, or where there is a lawful request.
  • To enforce legal rights. We may also share CHD to protect our customers, employees, or property; in emergency situations; to investigate, prevent, or take other action regarding suspected illegal activity, fraud, or other wrongdoing; and to enforce our rights under our terms of service and policies, in court or elsewhere.

Changes to Our Privacy Policy

We may update our Policy from time to time. If we make material changes to how we treat our users’ personal information, we will post the new privacy Policy on this page with a notice that the privacy Policy has been updated and may notify you via the App and/or email. The date the privacy Policy was last revised is identified at the top of the page. You are responsible for periodically visiting this privacy Policy to check for any changes.
